Terms & Conditions
All photographs will be shot in digital format. Digital photos will be delivered as JPEG files made available on a private online gallery. The online gallery will be ready about 4 weeks after your session. It will be the responsibility of the client to ensure copies of their images be downloaded and saved to personal devices, computers or external hard drives of their choice once handed over.
The fee for photographic coverage is inclusive of GST. This includes an online gallery, digital processing of the camera RAW files and all density and colour corrected high resolution images in JPEG format.
Upon your approval, Powderpuff Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason full payment is required to secure your allocated time.
You acknowledge that all work created under this agreement is the intellectual property of the Powderpuff Photography who shall retain the copyright to the photographs. You can agree to give Powderpuff Photography permission to use some of your images on social media formats please advise below. You will also give permission for the photographer to use the work for publication, display, advertising promotion and other uses.
You may post images on Instagram, Facebook or any other social networking website. You also agree not to digitally manipulate the image for public viewing and include a photo credit of “Photo By: Powderpuff Photography” or tagging with appropriate name with each image posted. You will have unlimited personal use of the photographs at any time for no additional fee.
While the photographer takes the utmost care with respect to exposure, processing and delivery of photographs, in the event that the images become lost, stolen or destroyed, for reasons within or beyond the control of the photographer, liability is limited to a refund of payment received. The limit of liability shall not exceed the contracted price. Powderpuff Photography will not be held responsible for any ruined photographs due to any other cause in or outside of Powderpuff Photography’s control.
Due to the recent pandemic I understand that there is so much uncertainty planning events however deposits/payments can only be refunded should government guidelines restrict you from moving forward with your event. This is includes government imposed lockdowns and if you or baby contract the virus. Change of mind is sadly non- refundable once you have confirmed your booking. I understand that these are difficult times for families but it has been equally difficult for small business like me so I appreciate your respect when agreeing to my terms and conditions and confirming me for your special day.
In the event Powderpuff Photography contracts covid-19 prior to your event date and is required by law to isolate every effort will be made to find a suitable replacement for your day and any monies paid will be refunded. I will be following health orders at the time of your day and will be wearing a mask and socially distancing where I can. Close contact with guests will be limited so some table photos may not be viable on the day depending on your venue set up. I trust you understand this decision.
In the event that Powderpuff Photography is unable to photograph your session due to: illness, emergency, accident, or act of God, every effort will be made to reschedule. If a rescheduling is unavailable, the payment(s) made to Powderpuff Photography will be refunded in full, and return of the payment(s) shall be the entire obligation under this contract. No other damages or guarantees of any kind are recognised or warranted.
Cancellations - Please read carefully!
Cancellation must be in writing. Cancellation of event less than four weeks prior to your event your deposit will not be refunded. Cancellations less than two weeks 65% of quote amount applies. Cancellation less than one week prior to your event a cancellation fee of 85% of quote amount will apply. Cancellations less than 48 hours prior to your event a cancellation fee of 100% of quote amount applies.
These terms and conditions incorporates the entire understanding of the parties. Any modifications of the terms and conditions must be in writing and acknowledged by both parties.
To confirm your booking please acknowledge acceptance of these terms and conditions below along with your 25% deposit or full payment if within two weeks of your event date.
